The Work:

The Client is hereby contracting with Idaho Poop Scoop Inc. (the Company) to remove and/or dispose of dog poop from the premises designated in the address line above (the Site).
The Company shall carry out and complete the work in a workman like manner and shall have no obligation to execute any additional work unless otherwise agreed in writing between the parties. The Client consents to the Company communicating with the Client via email, text, and/or telephone calls.

Access to Property:

The Client hereby grants license and permission to the Company to pass into, over and through yards, gates, alleyways, etc., in order to perform the work. Furthermore, the Client warrants that Client has the legal authority to grant such license and permission to the Company.
The Client understands that the Company may hire independent contractors to perform the work.
The Client agrees to provide unobstructed access to the Site, e.g. to include the removal of all vehicles and other obstacles, gates, doorways and passages clear of obstruction and unlocked and impacted neighbors notified as applicable. To the extent that the Client requests the Company services and does provide unobstructed access as described above, the Client waives all claims and assumes all liability that may arise from the Company’s attempts to pass through/by/over/under obstacles in order to perform the services.
The Client is responsible for obtaining any necessary permits or consents required for any work to be performed by the Company (both governmental and private). The Client represents and warrants the Company that all such permits and consents have been obtained prior to the scheduled commencement of any work and that the work contained in this agreement is permitted by all applicable laws.

Limitation of Liability:

The client acknowledges that the Company has disclosed that services will be provided by independent contractors who are not employed by the Company, and therefore waives any claim against the Company for any damages caused by an independent contractor. The client hereby waives any claim against the Company or any contractors working with/for the Company for any unintentional damages caused, either directly or indirectly, to the Client’s property. This includes, but is not limited to, damage to gates, fences, sprinklers, grass, pets, gutters, etc. The client hereby acknowledges that if their gate latches are either broken or not visible from the outside of the fence, that neither the Company nor any independent contractors working with the Company can guarantee that the client’s gate is latched and secure. Therefore, the client hereby waives any claim against the Company or its contractors for gates that do not remain closed if the latches to those gates are either broken or not visible from the outside of the fence.

Payment:

The Client understands and hereby agrees to and gives permission to the Company to charge the credit or debit card provided in the payment section of this form if there is a section of this form requiring credit or debit card information.
The Client understands that for subscription customers, a recurring payment will be charged to the Client’s credit or debit card every 7 or 14 days, depending upon the subscription, without notice or invoice. The Company shall not be held liable for any fees incurred by the client as a result of this automatic recurring payment.
All payments shall be charged and made in US Dollars.
The Client agrees that all payments (subscriptions, tips, etc) related to services received pursuant to this Agreement shall only be made to the Company.

Injuries to the Company’s Employees or Contractors:

The Client assumes all risk and financial responsibility to the Company or its agents for any injuries or damages caused by a Client animal. The Client agrees to pay for any and all damages suffered by the Company, the Company’s Employees or any Contractors hired by the Company if they are injured on the Client’s property because of negligence by the Client which produced an unsafe working environment.
